All Smith Autosports LLC
Effective Date: August 8, 2026
Your privacy matters to us. This policy explains what information we collect when you visit our website, book a vehicle, or rent from us — and what we do with it.
We've written this in plain language rather than legal boilerplate, because there are a few things about renting a vehicle that people genuinely should know before they book. The most important is Section 04. Our vehicles are equipped with GPS and telematics equipment that collects location and driving data while you have the car. That section also covers something people often overlook: information you leave behind in a vehicle's Bluetooth, navigation, or infotainment system — including your contact list and saved addresses — stays in the car after you return it unless you remove it. Please read that section before you rent.
Who We Are
All Smith Autosports LLC is a vehicle rental company based in Atlanta, Georgia, with vehicle pickup in Fairburn, Georgia. This policy covers our website, our rental operations, and any communications between us.
This policy works alongside our Terms and Conditions. Where the Terms describe what we do, this policy describes what information we handle in order to do it.
Read our Terms and Conditions.
Information We Collect
2.1 Information you give us
Identity and licensing
- Full name, date of birth, and address
- Driver's license number, issuing state, expiration date, and a copy or photograph of the license
- For international renters: passport details and International Driving Permit, where applicable
Insurance information
- Insurance carrier name and policy number
- Coverage limits and effective dates
- A copy of your declarations page or insurance identification card
- Any rideshare endorsement or commercial policy details you provide
We collect this because our Terms require every renter to carry their own automobile insurance, and we verify it at every pickup.
Payment information
- Credit or debit card details, processed through our payment providers
- Billing address
- Security deposit and transaction records
We do not store full card numbers on our own systems. Card data is handled by our payment processors.
Rental details
- Your declared use for the vehicle — personal, commuting, rideshare, delivery, or other
- Which gig platforms you've told us you drive for, if any
- Rental dates, vehicle preferences, pickup and return details
- Rental and payment history with us
Communications
- Emails, text messages, and messages sent through booking platforms
- Notes from customer service conversations
- Photographs and documents you send us, including incident reports
2.2 Information we collect automatically
Vehicle location and telematics data — see Section 04, which covers this in detail.
Website information
- IP address, browser type, device type, and operating system
- Pages visited, time on site, referring website
- Cookie and analytics data (Section 08)
Vehicle condition records
- Photographs of the vehicle at checkout and check-in
- Odometer and fuel readings
- Condition reports
These photographs are of the vehicle, but they may incidentally capture surroundings, other vehicles, or people nearby.
Video surveillance
- Security camera footage at our vehicle pickup and return location (Section 4.7)
Data left in vehicle systems
- Information you store in a vehicle's infotainment, Bluetooth, or navigation system during your rental (Section 4.5)
2.3 Information we obtain from others
Driving records. We review your motor vehicle record as part of rental qualification. This may be obtained through a third-party screening provider.
Identity verification. We may use verification services to confirm you are who you say you are and to detect fraud.
Booking platforms. If you book through Turo, TripCity, or another platform, we receive information from that platform about you and your reservation. What they share is governed by their privacy policies, not ours.
Tolls and citations. Toll authorities, law enforcement, and parking enforcement may send us notices identifying our vehicle, which we then match to your rental.
How We Use Your Information
We use your information to:
- Verify your eligibility to rent, including your license, insurance, and driving record
- Process reservations, rental agreements, payments, and deposits
- Manage our fleet, schedule maintenance, and track vehicle location and condition
- Communicate with you about your booking, your rental, and your account
- Investigate accidents, damage, and insurance claims
- Recover vehicles that are overdue, stolen, or being used in violation of our Terms
- Process tolls, citations, and violations, and forward your information to the issuing authority where the law requires it
- Collect amounts owed, including through a collection agency or attorney if necessary
- Comply with legal obligations and respond to lawful requests
- Improve our services and our website
- Send you promotional messages about vehicles and offers, if you've opted in
We do not use automated decision-making to approve or deny rentals. A person reviews every application.
GPS, Telematics, and Vehicle Data
It describes the most sensitive information we collect.
4.1 What the equipment collects
Our vehicles may be equipped with GPS tracking units, telematics systems, and event data recorders. Depending on the vehicle, these may collect:
- Location data, including the vehicle's real-time position and route history
- Mileage, including odometer readings and distance traveled
- Speed and driving data, including acceleration, braking, and in some cases harsh-driving events
- Vehicle diagnostics, including engine status, fault codes, fuel or charge level, and maintenance indicators
- Event data captured around the time of a collision, such as speed and braking in the seconds before impact
- Ignition, door, and battery status
This equipment operates continuously throughout your rental period, including when the vehicle is parked and when you are using it for personal purposes.
4.2 Why we collect it
We use vehicle data for:
- Fleet management and maintenance — knowing where our vehicles are, scheduling service, monitoring vehicle health
- Mileage verification, including confirming whether a mileage limit applies to your rental and whether it has been exceeded
- Recovery of overdue or stolen vehicles
- Verifying compliance with our Terms, including geographic restrictions and prohibited uses
- Investigating accidents and damage claims, including providing data to insurers, adjusters, and law enforcement where appropriate
4.3 What we don't do with it
We do not sell vehicle location data. We do not use it for advertising or profiling. We do not provide it to third parties for marketing purposes.
4.4 Who we may share it with
We may share vehicle data with our insurer and claims administrators, law enforcement in response to a lawful request or a stolen vehicle report, recovery agents, our telematics service provider, and — in a dispute over damage, mileage, or unauthorized use — with attorneys, insurers, or a court.
4.5 Data you leave in the vehicle
Many of our vehicles have infotainment, Bluetooth, and navigation systems. If you pair your phone or use the navigation system, information from your phone may be stored in the vehicle — including your contact list, call history, text messages, paired device name, and any addresses you enter or destinations you visit.
Unless you remove it, it remains in the car. We are not responsible for information you leave behind in these systems, and we cannot guarantee its privacy or confidentiality once the vehicle goes to another renter.
Before you return the vehicle, please:
- Unpair your phone from the vehicle's Bluetooth and delete it from the paired devices list
- Clear the navigation history, saved destinations, and any "home" or "work" addresses you entered
- Sign out of any accounts you logged into through the vehicle's system
- Perform a factory reset of the infotainment system if the vehicle offers one
We clear these systems during vehicle turnaround where we're able to, but the reset process differs by make and model and we cannot guarantee that every trace is removed. The reliable way to protect this information is to remove it yourself before you hand the keys back.
4.6 Manufacturer apps and connected car services
If you download the vehicle manufacturer's mobile app and register or add your rental vehicle to it, that manufacturer may begin collecting location, driving, and vehicle data directly from the car and associating it with your personal account.
That collection is governed by the manufacturer's terms and privacy policy, not ours. We don't control it, don't receive that data, and aren't responsible for how the manufacturer uses it.
If you register a rental vehicle in a manufacturer app, you must remove the vehicle from your account before returning it. Leaving it registered can mean the manufacturer continues associating that vehicle with you after your rental ends — and can mean the next renter's driving shows up in your account, or that your account retains access to a vehicle you no longer have.
4.7 Cameras at our pickup location
We may use video surveillance at our vehicle pickup and return location for security, loss prevention, and documenting vehicle condition at handover. These recordings may capture images of you, your passengers, and your personal vehicle.
Footage is used for security and to resolve disputes about vehicle condition, timing of pickup or return, or what occurred during a handover. We retain it for a limited period and then overwrite it, unless it's needed for an active incident, claim, or legal matter.
4.8 Driving behavior
Where our vehicles report driving behavior data — such as speed, harsh braking, or rapid acceleration — we may use it to enforce our Terms and Conditions. This includes investigating prohibited uses such as racing or off-road driving, evaluating damage claims, and deciding whether to rent to you again.
We don't monitor routine driving, and we don't issue surcharges based on driving behavior.
4.9 A note about personal privacy
We understand that a vehicle you rent for a week or a month becomes part of your daily life, and that its location reveals a great deal about you. We collect this data because we own the vehicle and need to manage and protect it — not to monitor your personal activities. We limit access to this data within our organization to people who need it for the purposes above.
If you are not comfortable with continuous location tracking, please raise it with us before booking so you can make an informed decision.
When We Share Your Information
We do not sell, rent, or trade your personal information.
We share information with:
| Who | What and why |
|---|---|
| Payment processors | Card and transaction data, to take payment and handle deposits |
| Our insurer (Roamly) and claims administrators | Rental, incident, and vehicle data, to manage claims on our fleet |
| Booking platforms (Turo, TripCity) | Reservation and rental information, where you booked through them |
| Telematics and fleet software providers | Vehicle and rental data, to operate our fleet systems |
| Driving record and identity verification services | Identity and license details, for rental qualification |
| Roadside assistance providers | Your name, location, and vehicle details, when you need service |
| Toll and citation authorities | Your name, address, and license details, where the law requires us to identify the driver |
| Law enforcement | Information required by subpoena, warrant, or lawful request, or when reporting a stolen vehicle |
| Collection agencies and attorneys | Account and contact information, where amounts are owed |
| Professional advisors | Accountants and lawyers, in the ordinary course of business |
Vehicle manufacturers. If you register a rental vehicle in a manufacturer's connected-car app, that manufacturer collects data directly from the vehicle under its own privacy policy. That is not a disclosure by us — see Section 4.6.
We may also share information if we sell or transfer the business, or where necessary to protect our rights, property, or the safety of others.
Service providers are permitted to use your information only to perform services for us, and are contractually required to protect it.
How Long We Keep It
We keep information for as long as we need it, which varies by type:
- Rental agreements, insurance verification records, and vehicle condition reports — retained for the duration of Georgia's applicable statute of limitations for claims arising from a rental, plus a reasonable margin
- Payment and tax records — as required by tax and accounting rules
- Accident and claims records — until the claim is fully resolved and any limitations period has run
- Telematics and location data — retained only as long as needed for fleet management, billing, and claims, then deleted or aggregated
- Security camera footage — retained for a limited period and then overwritten, unless needed for an active incident, claim, or legal matter
- Marketing contacts — until you opt out
- Website analytics — per the retention settings of our analytics provider
We keep insurance verification records deliberately and for a long time. If a claim arises from a rental years later, that record is how we demonstrate what coverage was in place.
Your Choices and Rights
Georgia does not currently have a comprehensive consumer data privacy statute. We offer the following regardless, because we think they're reasonable:
- Access — ask what personal information we hold about you
- Correction — ask us to fix information that's wrong
- Deletion — ask us to delete information, subject to the limits below
- Marketing opt-out — unsubscribe from promotional email at any time, or reply STOP to promotional texts
- Copy — request a copy of the information you gave us
Limits on deletion. We can't delete everything on request. We're required to keep rental agreements, insurance verification, payment records, accident documentation, and toll and citation records for legal, tax, insurance, and claims purposes. We'll tell you what we can and can't remove.
If you live in a state with a comprehensive privacy law — including California, Virginia, Colorado, Connecticut, Texas, Florida, Tennessee, and others — you may have additional statutory rights, including rights regarding targeted advertising and appeals of our decisions. Contact us and we'll work with you.
To make a request, email allsmithautos@gmail.com with "Privacy Request" in the subject line. We may need to verify your identity before we act, particularly for access and deletion requests. We aim to respond within 45 days.
Cookies and Website Tracking
Our website uses cookies and similar technologies to keep the site working, remember your preferences, and understand how visitors use it. We may use third-party analytics services that set their own cookies.
You can control cookies through your browser settings. Blocking them may affect how parts of the site function.
We do not currently respond to Do Not Track browser signals, as there is no common standard for how to interpret them.
Text Messages and Email
If you provide a mobile number, you agree we may contact you by text about your booking, your active rental, and any amounts owed. These are service messages, not marketing.
Promotional messages are separate and require your consent. You can opt out of marketing at any time without affecting service messages about an active rental. Message and data rates may apply.
If you're an active renter, we'll also send you direct contact information for the duration of your rental. Our email is monitored with automatic notification triggers, including outside business hours.
Third-Party Platforms
If you find us through Turo, TripCity, or another booking platform, that platform collects and handles your information under its own privacy policy, not ours. We receive only what the platform shares with us.
Similarly, if you drive for a rideshare or delivery platform using one of our vehicles, your relationship with that platform — including any data it collects about your driving — is between you and them. We don't receive it.
Our website may link to other sites. We're not responsible for their privacy practices.
Security
We use reasonable measures to protect your information, including encrypted transmission, secure payment processing through established providers, and limiting internal access to people who need it.
No system is perfectly secure, and we can't guarantee absolute security. If a breach affects your personal information, we will notify you as required by Georgia's data breach notification law (O.C.G.A. § 10-1-912).
Children
Our services are not directed to children. We do not knowingly collect personal information from anyone under 13. If we learn we have, we'll delete it promptly.
Separately, our vehicles may only be rented by people aged 21 and over, as described in our Terms and Conditions.
Changes to This Policy
We may update this policy as our practices or the law change. We'll post the updated version here and change the effective date. Material changes to how we handle vehicle location data will be communicated to active renters directly.
Continued use of our services after an update means you accept it.
